Introduction to the Help America Vote Act of 2002

Under the Help America Vote Act of 2002, Pub. L. 107-252, 42 U.S.C. 15301 et seq, states are required to implement certain election reform efforts to improve the election process for all voters. The requirements include:

  1. Using a voting system that meets the minimum requirements of the Act;
  2. Mandating provisional voting;
  3. Creating a statewide, central voter registration system;
  4. Requiring individuals registering to vote to provide certain information and requiring election officials to verify this information;
  5. Requiring certain voters to satisfy an identification requirement before voting;
  6. Requiring certain information be posted on Election Day; and
  7. Establishing an administrative complaint procedure for handling alleged violations of Title III of the Help America Vote Act.
